Basic Terms and Conditions
The services, work, products, and/or software provided by Cybertime Network Communications (“CNC,” or “we”), to you ("Subscriber," "User," or "you"), are subject to the terms and conditions of the following agreements, warrantees, Personal Privacy Act, and CNC’s operating policy. You shall be subject to any additional terms and conditions, which you are notified of and any which may apply when using third party content, software or services. CNS reserves the right to modify or amend this Agreement without notice at any time. You agree to regularly review these Terms and Conditions, the Personal Privacy and the Warranty, and if any of the rules, limits or requirements are unacceptable to you, you may terminate your subscription at any time provided you give CNC at least 30 days prior notice.
Notice of Use Agreement
Your continued use of CNC shall be conclusively deemed acceptance of any and all such Terms of Service, Personal Privacy Policies and Warrantees. Unless otherwise noted, or if your actions have caused damage to CNC, its reputation or equipment, your liability to CNC for any breach of this agreement is limited solely to the amount paid by you to access and use CNC or as prescribed by law. You agree that CNC only provides a connection to the internet and you are solely responsible for its use. You understand CNC reserves the right to disconnect your service and terminate this agreement due to copyright violations, software virus that may cause network problems with our system, court orders, or other legal government orders.
If CNC determines that your communications are legally questionable, or harmful to our equipment, or detrimental to the service of other users, we may suspend or terminate your service at our discretion without notice.
The connection provided by CNC requires an antenna to be professionally located and directed to a specific direction. From time to time this may need to be adjusted due to wind or other weather related conditions. CNC will make any required adjustments or upgrades to your equipment as necessary to deliver you quality service without a cost to you. However, if an adjustment is made by any other than a CNC technician, CNC may charge a service call fee to make any necessary adjustment.
User/Account Information
You represent that you are at least eighteen (18) years old. By registering as a Subscriber you will receive a Subscriber Account ("Subscriber Account"). This Subscriber Account includes a radio and antenna that is owned by CNC and is limited to a single connection at one location and you agree this connection will not be re-broadcast or transmitted beyond the intended location. In cases where a resident or a business may have multiple facilities on a single property, Wi-Fi extenders may be used to expand the area of coverage with the consent of CNC to ensure no radio interference to CNC equipment. If it is determined a Subscriber Account is being re-broadcasted or transmitted beyond the intended site, CNC can terminate services without notification at any time or CNC increase the monthly subscription rate equivalent with the use.
You are entirely liable for all activities conducted through your Subscriber Account and use by others who are using CNC services through your Account. You agree to provide CNC with accurate, complete, and updated subscriber and financial information. Failure to do so shall constitute a breach of this Agreement and unauthorized access to CNC, and may result in immediate termination of your account and/or subject you to civil and/or criminal liability.
At the termination of this agreement, regardless of the cause of termination, CNC retains the right to remove CNC installed radio and antenna at no further cost to you. If the CNC equipment is locked within a gated community or within a limited access facility, you agree to provide access for at least 20 days after the termination date for CNC to remove CNC equipment.
Access by Others
A Subscriber may permit another individual, including a minor, to freely use the Subscriber's Account at the Subscriber's discretion. Whether or not this action is subject to Subscriber supervision it is with the Subscribers assumption of all resulting liabilities for the other individual's actions. A CNC account may be installed and accessed by ONE host device. The account listed on any CNC paperwork or application may be accessed by the client listed on said paperwork or application. If the host device is a router or other connection sharing device, CNC may, it its discretion, assist you in setting up that device. All wireless routers or other similar wireless access devices used by client must be encrypted for exclusive use by the client. Pursuant to these Terms and Conditions, we reserve the right to interrupt service for clients using unencrypted wireless routers. Attempts at bypassing this provision will void your agreement with CNC and may result in a disconnection and revocation of your account without refund of any monies paid to CNC.
Reselling CNC
You may not at any time, or in any way, shape or form, resell any service or product of or provided by CNC. Any monies, income or advantage gained by unauthorized resale of any service or product of or provided by CNC is immediately forfeited to CNC as partial compensation for violation of this section.
NO GENERAL WARRANTY
Subscriber expressly agrees that use of CNC services are at subscriber's sole risk. CNC services are provided on an "as is," "as available" basis without warranties of any kind, either express or implied, unless such warranties are legally incapable of exclusion. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states CNC liability is limited to the extent permitted by law.

Privacy
CNC will not distribute or resell any information you provide to us without a court order for said information served on us by the proper authorities. If we terminate your service for breach of this agreement, this privacy guarantee is null and void. Any violation of any of the above will result in immediate deactivation of any and ALL services provided by CNC, without refund or any liability by CNC. If you do not agree to any part of the above, CNC will not provide any products or services to or for you. Your signature, mark of acceptance, or use of CNC services and/or products, whether physical or electronic, is proof of acceptance of these Terms of Service, Policies, Personal Privacy, and Warrantees. These Terms of Service, Policies, Personal Privacy, and Warranties are subject to change at any time, without notice, and your signature, mark of acceptance, or use of CNC services and/or products, whether physical or electronic, is proof of acceptance of any such changes.
